Hell, I’d argue that it’s basically what you would get if you smooshed together every one of Nihon Falcom’s (the developers of the Ys games) main series into one IP.
It doesn’t have to have competent game play to infringe on copyright. The name, advertising and design of the Ellie clone are all obvious copyright issues.

side note i love what i heard about the CEO of Larian of BG3 saying that he don t want to sell the studio to microsoft because he is worriered that a monolithic corporate owner like microsoft could end up limiting the studio creativity in the pursuit of profit. and that he prefer to be the one making the call than some distant corporate overlord that would prioritize efficiency and profit above all.

I got two issues: Does the Switch store include sreenshots in the games they sell? One look at those, and you’d know there was no way this was even half decent. Also, wouldn’t it make more sense that “not at all Ellie” was the protagonists mother? That would actually make the timetravel gimmick at least half way interesting.
The promotional art is definitely copyright infringement. You could argue that the Ellie replacement is as well. Otherwise, I’d agree that it mostly isn’t infringing copyright.
